Would You Drive Hands Free?

The Department for Transport (DfT) announced that “The UK is taking steps forward in automated technology in vehicles with the launch of a call for evidence” on August 18 2020.
The DfT said that the call for evidence will look at the Automated Lane Keeping System (ALKS) and will offer anyone with knowledge or concerns surrounding ALKS “opportunity to help shape future policy’.
So, what are Automated Lane Keeping Systems? ALK are used to keep vehicles within the lane and steer without any assistance from the driver. When in use, the ALKS would allow drivers to undertake other tasks, such as using their phone, whilst travelling. However, the law states that drivers must be prepared to take over manual control instantly when the vehicle indicated to do so.
It is worth mentioning that cars containing this technology already exist. Examples of cars with ‘autopilot’ or self-driving features include specific models by Tesla, Cadillac, Audi, BMW and Mercedes Benz.
There are five ‘levels’ of driverless vehicle technology. Car Magazine published an article in September of last year, 2019, explaining these levels. The ‘autopilot’ feature on current vehicles is generally classed as level one or two, but the ALKS technology would be classed as level three.
The call for evidence has been issued to clarify the rules and responsibilities surrounding ALKS technology. The DfT are looking for the answer to several questions, for example, what is the role of the driver when using an ALKS? Should a vehicle using ALKS be classed, legally, as an automated vehicle? If so, this would mean that the provider is ultimately responsible for the safety of any vehicle using the ALKS.
The DfT has indicated that the introduction of ALKS could be very soon, providing that the systems are approved. The announcement reads, “Following the approval of ALKS regulation in June 2020 by the United Nations Economic Commission for Europe (UNECE) - of which the UK is a member – the technology is likely to be available in cars entering the UK market from Spring 2021”.
